You acknowledge that each and every classified ad that appears on this website must consist of factual and properly formatted narrative content, images, and materials ("posted information"), all of which is to be self administered, authored and submitted ("posted") by legitimately identifiable individuals ("posters") in accordance with our Posting Policies hereinafter defined, and all of whom have either a legally registered business or lawful personal interest to present to and inform site visitors ("prospects") of the true features and specifications applicable to the Equipment, Real Estate, Transportation or More Great Stuff item(s) they posted in the most relevant category/subcategory combinations on this website, and such posters and prospects may elect to, at their sole will and unfettered discretion, engage in a mutually beneficial transaction related to same but in every case, prior to entering or completing any transaction, including but not limited to;
1) Leasing any item(s);
2) Taking over or transferring a Lease of any item(s);
3) Purchasing any item(s);
4) Renting any item(s);
and with particular reference to any item(s) a prospect has seen or may have become aware of as posted on LeaseArrangers, each prospect with interest in such item(s) is solely responsible for confirming the accuracy and validity of the posted information, and any other pertinent information ("non posted information"). And, as a Lease or a Lease Takeover of any item(s) may so apply, including but not limited to;
A) The monthly Lease payments;
B) The Lease Security Deposit (if any);
C) The original Lease start date;
D) The original Lease term;
E) The original Lease type;
F) The Lease end buyout (if any), including any residual value;
G) Any applicable transferring and administration fees;
H) Any applicable taxes;
I) Any applicable excess use, wear and tear, hour or mileage charges;
J) The actual age, brand name and original serial numbers;
K) Any liens, chattels or security agreements registered against the item(s);
All of which such posted and non-posted information is, in our opinion, critically important to the final decision of each and every prospect for the purpose of completing their respective transaction(s). You agree that the responsibility for the posted and non-posted information resides solely with the poster who posted their classified ad. As a poster you alone are responsible for all information that you post;
In any event, and although we shall randomly select and use our best efforts to review and investigate classified ads posted in any particular category or subcategory on LeaseArrangers, (as determined by reasonable cause), and with or without the assistance of a third party policing agent, you acknowledge that we shall not warrant or guarantee nor shall we be responsible for warranting or guaranteeing the accuracy of the posted and non posted information, and the validity or performance of any item(s) posted, and the legitimacy of the poster itself;
We have designed this website to enable public policing of all classified ad posting activities throughout, and specifically by way of giving each and every prospect the ability to "Report this Ad" (for distinct reasons), should a prospect believe there is sufficient cause to report any classified ad directly to us for such distinct reason(s);
Each Lease, Lease transfer, Sale/Purchase and/or Rental transaction process requires the respective parties (prospect and poster), or otherwise the potential lessee and lessor, buyer and seller, rentee and rentor, whichever the case may be to their respective transactions, to share or exchange certain information essential for completing the transaction ("transaction information");
Such information may include a person's business name, address, phone number, e-mail address, the product/item description details, general and/or specific financial information, and any other transaction information. You acknowledge that we may or may not be privy to any poster or prospect transaction information at anytime;
However, in the event we have been made privy to such transaction information from any prospect or poster, you acknowledge that we shall accept such transaction information as it is provided by those individuals who have provided it, and whether it is obtained directly from a prospect or poster and on that basis you acknowledge and agree that we cannot be and shall not be held responsible or liable in any way for verifying the accuracy of such transaction information or any outcome associated with or resulting from same;
We do not screen or pre-approve or later approve any item posted, nor any current or prospective lessee, lessor, buyer, seller, rentee or rentor. You acknowledge that LeaseArrangers is merely a host of the posted information for the respective parties to contact each other, and therefore, each prospect and poster themselves and/or their respective leasing or financing agent in any such transaction shall be responsible to screen, approve or deny, and facilitate the Lease or Lease transfer process, and the same shall apply as it relates to any item(s) to be purchased or rented, and as the respective parties shall also be responsible in the same manner;
By using LeaseArrangers as a host for your classified ad(s) you thereby acknowledge and agree that we reserve the right, at our sole discretion, to delete, move, or edit any classified ad(s) that we may so deem unacceptable or inappropriate, and whether or not such was deemed specifically for legal reasons;
You further acknowledge that we may or may not, during the normal or off hour course of standard business activities, review the content of electronic messages sent to us that are, or are not, addressed to a specific department or service area of LeaseArrangers. However, you acknowledge that we shall comply with all legal requirements regarding disclosure of such messages to others, including any law enforcement agencies that may so request such messages or any other pertinent information.
NO INAPPROPRIATE OR UNLAWFUL USES:
You agree not to use LeaseArrangers or any of its services offered in any way that violates the copyright, trademark, or other intellectual or proprietary property rights of any person or business entity. By self administering and posting a classified ad or multiple classified ads on LeaseArrangers, you are representing that you are the owner of each item described within each of your classified ads, or, that you are posting such classified ad(s) with the explicit consent of the owner of such item(s);
Our website services are available to both business representatives and non-business represented individuals. Those individuals who are making use of LeaseArrangers on behalf of a business must represent their respective company as an authorized representative, who is capable of acting on behalf of the company under the applicable laws where the company resides. You acknowledge that LeaseArrangers reserves the right, at its sole discretion, to deny or restrict the use of this website to anyone who uses any of the website services in a manner considered to be inappropriate, offensive, or of an illegal nature;
You agree not to use LeaseArrangers or any of its services offered in any manner that could damage, disable, overburden, or impair our web servers and network, or interfere with any other persons or party's use and enjoyment of any of our services. In the event you disagree with or find any information or materials posted on LeaseArrangers to be offensive, inaccurate, falsely stated or of an illegal disposition in any way, as a visitor we encourage you to, and as an account holder we expect you to, bring this to our attention immediately. Please forward either a copy of the classified ad, its reference number, or clearly refer to such information posted via our Contact Us addressed directly to our Content Administrator.
OUR POSTING POLICIES:
You acknowledge that each and every one of the following posting activities are NOT PERMITTED on LeaseArrangers.com:
1) Posting a classified ad that is not represented by a legitimately identifiable
Person or legally registered Business;
2) Posting or transmitting defamatory, abusive, obscene, threatening,
misleading, or illegal materials or information, or anything that may infringe
on the rights of others or interferes with the ability of others to enjoy the
use of LeaseArrangers.com;
3) Posting a classified ad without it consisting of a site relevant item available
or item wanted (only one item per ad);
4) Posting a classified ad that serves no other purpose than to promote either
business services, an employment opportunity, or to generate traffic to
another website;
5) Posting an item available classified ad that offers a stolen or illegally
obtained item, or an item which the poster is not lawfully entitled to offer;
6) Posting a classified ad that displays images or narrative content containing
nudity or pornographic material of any kind;
7) Posting a classified ad (item available or item wanted) that consists of more
than one item. (Each classified ad posted must be for one item only, and
such item must be relevant to a subcategory/category combination as listed
on this website);
8) Posting a classified ad more than once in any particular subcategory /
category combination on our site (duplicated ads in any one subcategory /
category combination are not permitted);
9) Posting a classified ad more than once with representation from different
locations i.e. different States, Provinces, Cities and Towns (this is also
considered a non permitted duplicate ad). No need to post your ad in
more than one location - your item will be found based on a variety of
different search types.
10) Posting a classified ad that has a typed in e-mail, website, video clip or
other e-address (URL) of any kind within the body of the ad without first
purchasing a weblink (hyperlinked URL). If a URL is inserted into the body of
any ad without the poster first purchasing a weblink or weblink credits via
the posting page, it will be automatically removed from the ad soon after it
is posted (for further details, please refer to How to Post Your Ad;
11) Posting an item available or item wanted classified ad that has no
relevance whatsoever to any of the classifications, categories, and
subcategories listed on this website.
OWNERSHIP OF POSTINGS AND COPYRIGHTS:
You agree that once you post any classified ad on this website you thereby give LeaseArrangers a non-exclusive license to publish and edit (if necessary) any of the information or materials you have posted. LeaseArrangers is not responsible for any damage to or loss of any information and materials you posted, which information and materials for definition purposes herein these Terms of Use may include; narrative content, photographs, video clips, PDF attachments, sketches or drawings, or any other materials you provide. PAYMENTS (Credit Card):
At LeaseArrangers posting classified ads is always FREE. However, as a poster you may elect to, at anytime, and at your sole option, promote your classified ad(s) and the item(s) applicable to your ad(s) by purchasing a featured ad position for your ad(s) in either one or more high profile/highly visible designated locations on our website, and with such positions being that of our Home Page gallery, Premium or Spotlight feature positions. Or, as a classified ad poster you may elect to, at anytime, and at your sole option, purchase a weblink or weblink credits for further promoting your item(s). Or, as a business advertiser, you may elect to, at anytime, and at your sole option, purchase a hyperlinked banner or video clip advertising position within any Search Result or Select page available on our site at the time. As well, you may elect to, at your sole option, make a purchase through your participation in any of the special promotions, service discount offerings, and various cost saving opportunities ("services & promotions") we may elect to offer you from our site at any given time. CANCELLATION POLICY:
Online & Telephone Orders:
Those who purchase any service(s) or product(s) online or by telephone (the "Purchaser") directly from L.A.com Inc. (the "Vendor") shall have the right to cancel their purchase at anytime upon completing the Vendor's Cancellation Request notice and sending it to the Vendor via online submission in order for the Vendor to issue a refund of any amount;
In any event, all refunds are subject to prorated calculation and payment from the Thirty-First (31st) calendar day after the original date of purchase, or, upon the 31st day after the Vendor receives the said Cancellation Request notice from the Purchaser, whichever date is the most recent. All refunds are subject to a Fifteen Percent (15%) cancellation fee of the pre-tax purchase amount originally paid by the Purchaser;
Prior to issuing a refund, the Vendor shall send to the Purchaser a refund summary by e-mail containing all refund calculations and the total refund amount for the purpose of obtaining the Purchaser's acceptance of such refund.
